St. Louis St. Louis Ban the Box Ordinance (Ord. 71074)

10+ employee St. Louis employers must delay inquiry until baseline qualification is established and document the job-relatedness of any disqualifying record.

Effective: January 1, 2021

Covered employers

Private employers with 10 or more employees in the City of St. Louis.

Timing of inquiry

Conviction inquiries prohibited until after the candidate's application has been reviewed and the applicant has been deemed otherwise qualified; arrest-only records may not be the basis for a decision.

Individualized assessment

Decision based on criminal history must rest on a determination that the conduct is reasonably related to the duties of the job; an across-the-board policy is impermissible.

Adverse-action workflow

FCRA pre-adverse and adverse-action notices required; the candidate must be given the chance to explain the record.

Notice & posting

Postings cannot include automatic-disqualification language.

Enforcement & penalties

St. Louis Civil Rights Enforcement Agency. Penalties up to $500 per violation, with private cause of action available.
