How a motor vehicle record, a criminal background check and an FMCSA Clearinghouse query differ, and which drivers each applies to.

What is the difference between an MVR, a criminal check and a Clearinghouse query?
An MVR shows a driver's license status, violations and suspensions from a state licensing agency. A criminal check shows court records. An FMCSA Clearinghouse query shows drug and alcohol program violations for CDL drivers. For interstate CMV drivers, FMCSA requires MVR inquiries; for CDL drivers it also requires a pre-employment Clearinghouse full query. Criminal checks are generally an employer policy choice for drivers.
Which rule applies to which driver
Part 391 driver qualification rules, including MVR inquiries for each state licensing a driver in the past three years and an annual MVR review, apply to drivers of commercial motor vehicles in interstate commerce as defined in 49 CFR 390.5.
Part 382 drug and alcohol testing, including Clearinghouse queries, applies to drivers who need a commercial driver's license. A non-CDL interstate CMV driver is covered by Part 391 but not Part 382.

Yes. A full query requires the driver's electronic consent in the Clearinghouse.
Is a criminal check required for truck drivers?
Not by general FMCSA rules. Some cargo types, clients or state rules may require one; otherwise it is a policy choice subject to FCRA and fair-chance laws.
