CDL and Non-CDL Driver Screening: Key Differences
Screening differences between CDL drivers, non-CDL interstate CMV drivers and drivers outside FMCSA rules, with a decision table.
Short answer
How is screening different for CDL and non-CDL drivers?
CDL drivers are covered by both FMCSA driver qualification rules and the Part 382 drug and alcohol program, so they need MVRs, previous-employer inquiries, a pre-employment drug test and a Clearinghouse full query. Non-CDL drivers of interstate CMVs need the driver qualification steps but not Part 382 testing or Clearinghouse queries. Drivers outside both, such as most car and cargo-van delivery drivers, are screened by employer policy.
Start with the vehicle and the trip
Whether federal rules apply depends on the vehicle's weight rating, passenger count, hazmat placarding and whether the trip is interstate. The definitions in 49 CFR 390.5 control. Intrastate drivers may fall under state rules that mirror federal ones.

Can we run a DOT drug test on non-CDL drivers?
No. DOT-form testing is limited to DOT-covered employees. Use a non-DOT test under your own policy and state law.
