Truck driver background check

CDL and non-CDL commercial driver hires are governed by the Federal Motor Carrier Safety Administration (FMCSA) in 49 CFR Part 391. The DOT-regulated screening package layers on top of the FCRA-required components — miss a piece and the driver cannot legally be dispatched.

Why it matters

A dispatched driver without a valid PSP, CDLIS, and drug/alcohol Clearinghouse query exposes the motor carrier to per-incident FMCSA civil penalties and out-of-service orders. Insurance underwriters routinely audit these files.

Common disqualifiers

  • Suspended, revoked, or disqualified CDL
  • Positive pre-employment DOT drug test or Clearinghouse violation without completed return-to-duty
  • Major disqualifying conviction under 49 CFR §383.51 (DUI, hit-and-run, felony involving commercial vehicle)

Frequently asked questions

Do I need a Clearinghouse query for a new CDL hire?

Yes. Since January 6, 2020, every CDL hire requires a pre-employment full Clearinghouse query with the driver's consent. Annual limited queries are required for every subsequent year of employment.

How far back does an MVR go for a truck driver?

DOT requires a 3-year MVR from every state the driver has held a license in during the last three years. Most carriers pull the full driving record available from each state as a safety and insurance best practice.

Is FMCSA PSP mandatory?

PSP is not mandatory, but it is strongly recommended by FMCSA and universally used by insured motor carriers. It returns 5 years of DOT-recordable crash data and 3 years of roadside inspections.
